Pursuant to Article 13 of the European Regulation 2016/679 (the “Privacy Regulation”), MOTOHUB SWISS GmbH wishes to inform all users and/or visitors of the website www.cfmotoschweiz.ch (respectively, the “Users” and the “Site”), regarding the use of personal data, log files and cookies collected through the Site.


1. Owner and Data Protection Officer.

The owner of the processing of personal data is MOTOHUB SWISS GmbH, with registered office at. Simon-Fricl-Strasse 18, 9466 Sennwald (St. Gallen (SG)), Switzerland (hereinafter the “Data Controller”).

The company has not appointed a Data Protection Officer.

The computer systems and software procedures used to operate this site acquire, in the course of their normal operation, some personal data whose transmission is implicit in the use of Internet communication protocols.

These data, which are necessary for the use of web services, are also processed for the purpose of:

  • Obtain statistical information about the use of services;

  • Monitor the proper functioning of the services offered.

Browsing data do not persist for more than 30 days (except for any need for the investigation of crimes by the judicial authority).

Purposes: To allow access to material exclusively dedicated to registered subjects (Restricted Area);

Legal basis: consent/contract execution

Retention times: Until request for deletion from restricted area

Type of service: contact area for products/services

Type of personal data collected: master data, contact data (e.g., e-mail, phone numbers)

Purposes: To acquire by filling out the appropriate form the references of users of the site to fulfill requests for informational/commercial contact (Contact Area);

Legal basis: consent/contract execution

Retention times: 24 months from acquisition or renewal of contact

Data processing for the above purposes will be carried out in accordance with the Privacy Regulations and all specific industry regulations.

The data provided will be processed mainly by computer tools under the authority of the Data Controller, by persons specifically appointed, authorized and instructed in the processing pursuant to Articles 28 and 29 of the Privacy Regulations. Please note that appropriate security measures are also observed pursuant to Articles 5 and 32 of the Privacy Regulations to prevent data loss, illicit or incorrect use and unauthorized access.


4. Compulsory or optional nature of consent for the provision of data

The provision of data is optional, but if it is not provided, it will not be possible to use some of the services provided by our site.


5. In what scope can we transmit the data

Data may be disclosed, within the EU, in full compliance with the Privacy Regulation, to the following entities:

  1. to the tax authorities and/or other public authorities where required by law or at their request;

  2. to the facilities, individuals and outside companies that the Owner uses to carry out activities related, instrumental or consequential to the performance of the Site Services.

The information automatically collected by the Site may also be transferred to Third Party cloud servers located also Outside the EU, if such processing is necessary for the performance of the Site’s services. The legal basis of said processing is, therefore, Article 49, paragraph 1, letter b of the Privacy Regulation.


6. Security Measures.

Through the Site, data is processed in compliance with applicable law and using appropriate security measures in accordance with applicable law also pursuant to Articles 5 and 32 of the Privacy Regulations.

Among other things, appropriate security measures are taken to prevent unauthorized access, theft, disclosure, modification or destruction of processed data.


7. Rights

Please note that at any time you may exercise your rights under Articles 15 et seq. of the Privacy Regulations.

To exercise these rights, please fill out the contact form available on the Site, with the aim of obtaining:

  • confirmation of the existence or non-existence of personal data with indication of their origin, verify their accuracy or request their updating, rectification, integration;

  • access, deletion of data or restriction of processing;

  • transformation into anonymous form or blocking of data processed in violation of the law.

One may also object to the processing of personal data previously provided.

8. Changes to the Privacy Policy

The Owner reserves the right to make changes to this Privacy Policy, replacing previous versions.
