MOTOHUB SWISS GmbH<\/b><\/span> (hereinafter, the \u201cController\u201d), as the Data Controller, in accordance with Article 13 of the EU Regulation 2016\/679 (hereinafter, the \u201cPrivacy Regulation\u201d) and the Swiss Federal Data Protection Act (DPA), collects and subsequently processes personal data relating to its Customers and Suppliers (hereinafter, the \u201cData Subject\u201d). <\/p>\n

1. Types of data being processed<\/b><\/h3>\n

The personal data being processed consist of:<\/p>\n

    Common personal data<\/b><\/span>: information such as biographical data and contact information (phone number and e-mail address).<\/p>\n<\/li>\n

    Special data<\/b><\/span> (if applicable and in cases allowed by the regulations).<\/p>\n<\/li>\n<\/ul>\n

    2. Purposes and methods of processing<\/b><\/h3>\n

    The Data Subject’s personal data are processed as part of the normal business of the Data Controller for:<\/p>\n

      Proper and complete performance of the obligations arising from the contractual relationship (hereinafter, the \u201cContract\u201d);<\/p>\n<\/li>\n

    2. \n

      Administrative and accounting requirements related to the Contract;<\/p>\n<\/li>\n

      Compliance with applicable regulations (laws, regulations or community provisions);<\/p>\n<\/li>\n

    4. \n

      Sending promotional communications regarding products and services similar to those already purchased.<\/p>\n<\/li>\n<\/ol>\n

      The processing is carried out using manual, computerized or telematic instruments, with logic strictly related to the purposes and according to organizational and technical criteria suitable to guarantee the security and confidentiality of the data, under the authority of the Data Controller and by specially authorized individuals. It may also take place through third parties appointed as external Data Processors in accordance with Article 28 of the Privacy Regulations and Swiss law. <\/p>\n

      3. Legal basis of processing and nature of conferral<\/b><\/h3>\n

        Points 1, 2, 3<\/b><\/span>: The provision of data is mandatory, necessary for the execution of the Contract and to fulfill fiscal and administrative obligations. Without such data it will not be possible to establish or continue the contractual relationship. <\/p>\n

        Legal basis<\/b><\/span>: execution of the Contract and fulfillment of legal obligations.<\/p>\n<\/li>\n

      • \n

        Item 4<\/b><\/span>: Sending promotional communications to existing customers based on legitimate interest of the Data Controller. The Data Subject may object to such communications at any time. <\/p>\n<\/li>\n<\/ul>\n

        4. Disclosure of personal data and recipients<\/b><\/h3>\n

        Personal data may be disclosed to the following categories of individuals:<\/p>\n

          Financial administrations and relevant public authorities;<\/p>\n<\/li>\n

        • \n

          Banking institutions for payment processing;<\/p>\n<\/li>\n

        • \n

          External parties performing control activities (auditors, boards of auditors, supervisory bodies);<\/p>\n<\/li>\n

          Credit management and legal protection companies;<\/p>\n<\/li>\n

          External parties appointed as Data Processors for purposes strictly related to the execution of the Contract.<\/p>\n<\/li>\n<\/ul>\n

          5. Transfer of personal data to non-EEA countries<\/b><\/h3>\n

          Data will not normally be transferred outside the European Economic Area (EEA) or Switzerland.<\/p>\n

          Should it be necessary for contractual or legal requirements, the transfer will take place in compliance with applicable law (Privacy Regulation and DPA), adopting appropriate safeguards such as adequacy decisions, standard contractual clauses or other suitable legal instruments.<\/p>\n

          6. Period of data retention<\/b><\/h3>\n

          Personal data are kept for:<\/p>\n

            Contractual and legal obligations<\/b><\/span>: up to 10 years after termination of the contractual relationship, in accordance with civil, tax and regulatory regulations.<\/p>\n<\/li>\n

            Promotional purposes towards acquired customers<\/b><\/span>: until the right to object is exercised or, failing that, for up to 24 months after collection.<\/p>\n<\/li>\n<\/ul>\n

            At the end of the retention period, the data will be deleted or anonymized, unless otherwise provided by law.<\/p>\n

            7. Rights of the Interested Party<\/b><\/h3>\n

            The Interested Party, pursuant to Articles 15 et seq. of the Privacy Regulations and Articles 25 et seq. of the DPA, may exercise the following rights:<\/p>\n

              Correcting or updating inaccurate or incomplete data;<\/p>\n<\/li>\n

            • \n

              Deletion of personal data in the cases provided;<\/p>\n<\/li>\n

              limitation of processing;<\/p>\n<\/li>\n

            • \n

              Portability of data in a structured format;<\/p>\n<\/li>\n

            • \n

              Opposition to processing for legitimate reasons or for promotional purposes.<\/p>\n<\/li>\n<\/ul>\n

              The Interested Party may exercise its rights <\/span>by completing the contact form available on the site<\/b>.<\/span><\/p>\n

              He also has the right to file a complaint:<\/p>\n
